Tesla, a whistleblower, who has been contested by Elon Musk and his company for years, has won the latest round of a long -running legal battle.
Engineer Christina Balan, in 2014, losed her job after raising concerns about a design defect, which could affect cars breaks.
His defamation claim against the firm seemed that when a judge confirmed the arbitration decision, he rejected his case – but a panel of appeal judges in California This decision has changed to her right.
She told BBC News that she now wants to face Elon Musk and Tesla in the open court.
Tesla has not responded to a comment.
Ms Balan said she believes the matter will now go back to a square One, and a new action can be initiated.
“We are hoping that we will start a new case and we will have the opportunity to compete with Elon Musk in front of the jury and the judge,” he said.
The engineer was once so prominent in Tesla that its initial model was engraved on batteries inside the vehicles.
Interviewing BBC News last year, He said he was determined to prove his innocence for his son.
She also revealed that she was apologizing for stage -3B breast cancer, and her biggest problem was that she could not survive to see her last day in court.

Ms Balan claimed that she was worried that the carpet was curling under some pedal in Tesla models, which was at risk of safety.
He said the managers dismissed his concerns, suffered enmity, and he lost his job.
He then won the case of wrongdoing – but it began a long journey through the courts.
Ms Balan was publicly accused by Tesla of using her resources for a “secret project” – the allegations that are a crime under US law.
He has constantly denied the allegations, and decided to bring a defamation case against the firm in 2019.
“I want to clear my name,” he told BBC News last year. ”
“I wish Elon would have been humble to apologize to Musk.”

After that, a court decided that the case of Ms Balan should be subject to mediation as per the agreement, which she signed for Tesla.
Due to the law of California, it was found in favor of firm and musk, rejecting its claims – which means that much time had passed after alleged notorious statements were made.
Tesla returned the case to a district court in California to confirm the verdict.
However, Ms Balan appealed for the decision, and the judges of the US court appeal for the ninth circuit found in favor – the fact is that the California court has no jurisdiction to decide.
They have ordered the cancellation of the arbitration award, and ordered the proceedings to be rejected due to a lack of jurisdiction of the district court.
